Welcome to the TrainGOP, Inc. (“Company,” “We,” “Us,” “Our”) Terms of Service (“Terms”). These Terms outline your legal rights and responsibilities when using the products, services, websites, training materials, and other offerings provided by TrainGOP, Inc. (collectively, the “Services”).

TrainGOP, Inc. provides educational resources, training programs, tools, and support intended to help conservatives, Republican candidates, volunteers, campaign staff, local party leaders, elected officials, and community members become more involved in public service, campaigns, and civic engagement.
By accessing, registering for, or using any TrainGOP, Inc. Services, including websites, applications, content, training materials, videos, downloads, community forums, learning management systems, campaign tools, and related offerings (collectively, the “Service Offerings”), you are entering into a binding agreement with TrainGOP, Inc.
You acknowledge that you have read, understood, and agree to these Terms and all related policies. If you do not agree to these Terms, you may not access or use the Service Offerings.

All TrainGOP names, trademarks, logos, slogans, domain names, and branding elements are the sole property of TrainGOP, Inc. You may not use any TrainGOP brand assets without prior written consent.
You are responsible for maintaining the confidentiality of your username and password.
You are responsible for all activity occurring under your account. If you believe your account has been compromised, you must notify us immediately and update your password.
You may have the ability to upload, submit, post, or share content through the Service Offerings, including text, photos, campaign materials, messages, forms, comments, feedback, or other information (“User Content”).
By posting User Content, you represent that:
TrainGOP, Inc. reserves the right, but not the obligation, to review, remove, edit, restrict, or disable User Content at its sole discretion.
You remain solely responsible for all User Content submitted through your account.
You may request changes to your account information by contacting us.
You agree to indemnify and hold TrainGOP, Inc. harmless against any claims arising from User Content you submit or post.

TrainGOP, Inc. may add, remove, modify, suspend, or discontinue portions of the Service Offerings at any time without liability.

By submitting User Content, including comments, feedback, suggestions, testimonials, photos, videos, or campaign materials, you grant TrainGOP, Inc. a non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use, display, reproduce, distribute, modify, publish, and create derivative works from such content in connection with the Service Offerings.
You retain ownership of your User Content, but you grant us the rights necessary to operate, improve, market, and promote the Services.
All copyrights, trademarks, logos, content, training materials, graphics, videos, software, and other intellectual property associated with TrainGOP, Inc. remain the exclusive property of TrainGOP, Inc. or its licensors.
Nothing in these Terms grants you any ownership rights in the Service Offerings or any TrainGOP intellectual property.
We strive to keep the Service Offerings available and operational; however, we do not guarantee uninterrupted access.
The Services may occasionally be unavailable due to maintenance, technical issues, security incidents, upgrades, or other reasons.
TrainGOP, Inc. is not responsible for downtime, data loss, or interruptions in service.
The Service Offerings may contain links to third-party websites, software, tools, integrations, sponsors, or other resources.
TrainGOP, Inc. is not responsible for the availability, accuracy, content, or practices of third-party services.
Your interactions with third-party providers are solely between you and that provider.

These Terms remain in effect until terminated by either you or TrainGOP, Inc.
You may stop using the Services at any time.
TrainGOP, Inc. may suspend or terminate your account at any time for violations of these Terms or for any other reason deemed necessary to protect the Company or its users.
Sections relating to intellectual property, indemnification, dispute resolution, limitation of liability, and similar provisions will survive termination.
THE SERVICE OFFERINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
TRAIN G O P, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.
WE DO NOT GUARANTEE THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAIN G O P, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, AFFILIATES, CONTRACTORS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRAIN G O P, INC. DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
You agree to indemnify, defend, and hold harmless TrainGOP, Inc. and its officers, directors, employees, contractors, affiliates, and representatives from any claims, liabilities, damages, losses, costs, and expenses arising out of:
These Terms shall be governed by and interpreted under the laws of the State of Tennessee, without regard to conflict of law principles.
Any disputes relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Tennessee.
At TrainGOP, Inc.’s discretion, disputes may be resolved through binding arbitration in Tennessee in accordance with the rules of the American Arbitration Association.
You agree that any dispute will be handled on an individual basis and not as part of a class action or representative proceeding.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and any additional agreements or policies, constitute the full agreement between you and TrainGOP, Inc. regarding the Service Offerings.
